Government issue response to Online Petition

The UK Government have responded to the online petition by issuing the following statement:-

'Courts in England and Wales have powers under the Bail Act 1976 which can be used to prevent a
person charged with a road traffic offence from driving whilst awaiting trial.

A court may decide to grant bail, but only under certain conditions. This could include a
requirement that the defendant should not drive prior to the court hearing. Should a bail condition
be broken, the defendant would be liable to immediate arrest. In making its decision, the court must
consider all the circumstances of the case that appear to be relevant. It is widely accepted that
the courts are in the best position to weigh up all the relevant factors, taking account of
prosecution submissions, which in turn are largely based on the recommendations of the
police.'

In an immediate response, Dave Malcolm from Campaign4Carl and rememberingfergy said:-

'This response from the Prime Minister's office does not surprise me, and it clearly shows
that Government have clearly ignored the fundemental issues surounding the campaign.

As we have repeatedly explained to the Government, the issue is not one of whether legislation
exsists, it is an issue of whether the current legislation is utilised in a way that makes it
effective. Any person who drinks and drives and kills someone does not go to court until the Police
have finished their investigation and reccomended a charge be brought. Once they have sobered up,
they are released on Bail and are free to leave the Police Station and get behind the wheel of a car
- even if they killed someone 24 hours earlier! This Investigation takes many months and the accused
driver is free to carry on driving until they go to court. The Police do not apply for an Interim
Driving Disqualification - and neither do the CPS. In our case, Jamie Crozier was even free to carry
on driving even after he pleaded Guilty - even though he had just finished a previous drink driving
ban! The CPS who are supposed to know the Law never bothered to apply for an IDD (Interim Driving
Disqualification and claimed to us that Mr Crozier could not be taken off the roads early! What does
it take to get the Government to act? We have always said that The Police should have the power to
automatically apply for an interim driving disqualification as part of Police Bail conditions but
they are not We feel that this is because of Budgetery constraints. We want to know what guidelines
the CPS and the Government have issued to Police Forces in regard to I.D.D's , and we want to
know why high risk offenders are not being taken off the roads immediately. We want to know why the
Government have chosen to ignore the advice of The Institute for Alcohol studies for the past 10
years, and also road safety charities such as CADD and SCARD. We re-itterate our call for compulsary
Interim Driving Disqualifications for any driver tested and found to be over the prescribed limit,
and we will up the 'Ante' until the Government see's Common Sense and introduces
legislation to make this happen. We should not have to campaigning for this, the Government are
supposed to lead by example, yet again Offender's rights are taking precedence over the rights
of innocent people to be protected - and the sooner the Government realise that this issue is not
going away and needs sorting, the better'

We all wonder each and every day what the day will hold. We know we will have problems, but like
always we will survive. We go about our day not thinking about the danger or trouble outside on the
roads and highways connecting our towns. There is a danger that is there which in a split second can
change the lives of many people.

Imagine you are a mother who has just watched her child that morning leave in her car to go to the
store not even giving a thought to the danger which may occur. She goes back in the house and a
while later she gets a knock at the door. It is a police officer with the news that your child was
just killed in a car accident.

Car accidents happen and are tragic to say the least. In this instance it could have been avoided.
The young girl was killed by a drunk driver. Someone who got into a vehicle, thinking they were
sober enough to drive. This person thought he saw a car, but the alcohol had blurred his vision. By
the time he realized what was happening, it was too late. Someone's child had died, and it was
his fault.

Drunk driving is a deadly killer. When a person drinks and gets behind the wheel of a vehicle, they
are holding a deadly weapon. They are not just putting their own life in of danger, but that of many
innocent people. Every person they pass, get in front of, or behind are in danger.

When I was younger I lost many friends in drunk driving accidents. One of my best friends was killed
in an accident where everyone but the driver died. Three died in that crash and not one of them was
over 20.

I was in an accident not long ago where a driver rear-ended us. We all made it out unharmed, but the
car was totaled. That's fine because cars can be replaced. People can't. I was grateful no
one was hurt. The driver of the other vehicle had taken his eyes off the road for a second while we
were turning into a gas station. He had not been drinking.

If this guy sober, could cause a bad crash by taking his eyes off the road for a split second, where
does that place someone who has been drinking?

every single day the drivers on our roads make choices and decisions. most of them drive within the
law, but some make choices that shatter the lives of many people..

some choose to drive erratically, some choose to get behind the wheel when they have had too much to
drink, some choose to speed or race, some choose to show off to other passangers in the car, on the
bike etc etc etc..........................................

when we lose a loved one on our roads, the aftermath that is left behind is earth shattering, life
changing for the worse and leaves us in limbo for years to come for the needless way in which our
loved ones have been taken...........................................

is there any justice in the world? well the law and government says yes, what about the famalies who
have lost a loved one due to drink driving, carless driving, etc etc? i think not. yes some of the
drivers go to prison, some get off on a technicality some are just found not guilty. prison we think
is a place where people who have done wrong are sent to be punished, nah is it heck all that is just
a load of political clap trap said by our heads of departments.. ie. department of transport.

please if you can and are interested watch bb2 from 11.30 am on wed 19th march where a polititian
from the tories is gunna be asking questions regarding the law and drink driving. the mp is robert
goodwill, please set tapes if you not in. i think it will be quite interesting.




it will be 2 years on tuesday 18th march that my son carl was killed by a drink driver.
the killer was sentenced on 20th feb 2007 to 4 years in prison and yesterday i got sent this letter
from the west yorkshire probation service which absalutly disgusts me.

dear dawn,
further to my visit to you in june 2007, i am writing to inform you that mr crozier has recently
made an application to move into open conditions within the prison system.

if the parole board agree the move, mr crozier will be eligible to apply for unescorted time away
from the prison which may include overnight stays.

i will write again in due course to confirm if mr crozier's application has been agreed.

so what does that say about our justice system?
to me it stinks.
my sons killer has been given a chance to ask to be moved to a low security outdoor prison and may
even be rewarded with night and days out.

that is what is happening to people in prison,
just over a year inside and he may get to go on the outsede again, so what was the point in being
given a 4 year sentence.
i have today emailed my local tv station, local radio, local press and the sun newspaper. things
like this need to be put into a much wider public domain so that other find out about what is
happening.

carl did nothing wrong apart from enter a car when it pulled up along side him and he was offered a
lift home. i have done nothing wrong, yet i have suffered so much (as i know all of you have) for
the last 2 years, now there is a chance of this lad walking the same town as me much much sooner
than the judge said.




this site is in memory of all the people who have been killed by drink drivers.
we as famalies would love to be in touch with other bereved famalies to try and work together and
help each other at very very sad times in our lives.
please feel free to leave a tribute to your loved ones, or if passing through please light a candle
for all those who have been needlessly killed on our roads.

Why are you crying, a young boy asked his Mom?

even when everyone else gives up, through sickness and fatigue without

I gave her the sensitivity to love her children under any and all
circumstances. Even when her child has hurt her badly....
She has the very special power to make a child's boo-boo feel better and
to quell a teenager's anxieties and fears....
I gave her strength to care for her husband, despite faults
and I fashioned her from his rib to protect his heart....
I gave her wisdom to know that a good husband never hurts his wife, but
sometimes tests her strengths and her resolve to stand beside him
unfalteringly....
For all of this hard work,
I also gave her a tear to shed.
It is hers to use
whenever needed and !
it is her only weakness....
When you see her cry,
tell her how much you love her, and all she does for everyone, and even though
she may still cry, you will have made her heart feel good.
She is special!

MADELEY DAUGHTER ON DRINK DRIVE CHARGE

Chloe Madeley was a presenter on her parents' show
The daughter of TV stars Richard Madeley and Judy Finnigan has been charged with drink-driving after her car overturned in north London.

Chloe Madeley, 22, was arrested after a crash in Barnet, north London, in the early hours of Sunday.

Police found a Peugeot 206 on its roof after it apparently hit a parked Mini. No one was at the scene.

Police traced Miss Madeley as the owner and she was arrested at her parents' home in north London.

She is on bail and will appear at Hendon Magistrates' Court on 2 September, a Metropolitan Police spokesman said.

Miss Madeley worked as a showbusiness reporter on the chat show, New Position, which was hosted by her parents.

She has also presented Big Brother's Big Mouth and posed for FHM magazine.

Chat show couple Richard and Judy ended more than two decades on television in July when they hosted their final show on satellite channel Watch.

We are painfully aware that life can never be the same again, that yesterday is over, that relationships, once rich, have ended. But there is another way to look upon this truth. If life went on the same without the presence of the one who died, we could only conclude that the life we here remember made no contribution, filled no space, meant nothing. The fact that this individual Left a space that cannot be filled Is a high tribute to this individual. Life can be the same after a trinket has been lost, But never after the loss of a treasure.

MOTHERS

The young mother set her foot on the path of life."Is this the long way?" she asked. And the guide said "Yes, and this way is hard. You will be older before you reach the end of it. But the end will be better than the beginning." But the young mother was happy, and she would not believe that anything could be happier than these years. So she played with her children, she fed them and bathed them, and taught them how to tie their shoes, ride a bike and reminded them to feed the dog, and do their homework and brush their teeth. The sun shone on them, and the young Mother Cried "Nothing will ever be lovelier than this." Then the nights came, and the storms, and the path was sometimes dark, and the children shook with fear and cold and the mother drew them close and covered them with her arms, and the children said, "Mother, we are not afraid, for you are near, and no harm can come. And the morning came, and there was a hill ahead, and the children climbed and grew weary, and the mother was weary. But at all times she said to the children, a little patience and we are there." So the children climbed, and as they climbed they learned to weather the storms. And with this, she gave them strength to face the world. Year after year, she showed them compassion, understanding, hope, but most of all...Unconditional Love. And when they reached the top they said, "Mother, we would not have done it without you." The days went on, and the weeks and months and the years, and the mother grew old and she became little and bent. But her children were tall and strong, and walked with courage. And the mother, when she lay down at night, looked up at the stars and said, "This is a better day than the last, for my children have learned so much and are now passing these traits on to their children." She's the sound of the rain that lulls us to sleep, the colors of the rainbow, she is Christmas morning. She shows every emotion...Happiness, sadness, fear, jealousy, love, hate, anger, helplessness, excitement, joy, sorrow...and all the while, hoping and praying you will only know the good feelings in life. She's the place you came from, your first home, and she's the map you follow with every step you take. She's your first love, your first friend, even your first enemy, but Nothing on earth can separate you.

GEORGE MICHAEL

London: In a bizarre incident singer George Michael was arrested on suspicion of driving under the influence of alcohol or drugs after his car crashed into the back of a lorry.

The singer who got his license just two months back after a two year ban, was breathanalysed at the side of the road and was taken into police custody after the incident, the Dailymail reported.

The 'Faith' hitmaker was reportedly held by the police for almost five hours before being released without charge.

"He seemed completely disorientated, like he had no idea what was going on. He looked totally dazed and even tried to climb into the cab of my lorry. He kept saying he was worried he would go to jail," Laurie Rowe, the driver of the lorry said. The 46-year old singer crashed with such a heavy bang that the driver thought that he might be dead.

"He hit me so hard that it knocked my rear axle two feet up in the air. When I stopped the lorry and got out to see what had happened, I didn't think he would have survived," the driver added.

IT DOESN'T SEEM TO MATTER

The ice cream man is coming,
I can hear him ring his bell,
The children run to meet him,
To buy the goodies he sells.
They never even notice,
The cars out in the street,
The only thing you hear is,
The sound of running feet.
But then one day it happens,
A car comes speeding by,
He had to much to drink so,
Somebody's going to die.
He doesn't even realize,
The life he's going to take,
He doesn't stop to think of,
The hearts he's going to break.
He doesn't hear the sound of,
A mother when she screams,
It doesn't seem to matter,
That he took away her dreams.
His mind is really cloudy,
He isn't thinking clear,
How could he think of driving,
After drinking all that beer.
Some day our prayers will be answered,
Drunk driving will finally cease,
the drivers that took our loved ones away,
will finally rest in peace.
